You must be a citizen of a country with which the United States has an E2 treaty and you must intend to depart the United States when your E2 status expires. You must make a significant investment in a US company and your E2 business must be operational and for-profit. Moreover, the company in which you invest cannot be regarded as a minor business. You must enter the United States in order to manage and expand your E2 firm. Furthermore, the origin of your investing capital must be legal. Your investment must be risky and irrevocably committed to the E2 business.

Procedure for getting an E2 visa

After hiring an immigration attorney, your case will be reviewed. Then, they will give you a list of all the required documents for your E2 visa application.

Clients spend approximately one-month collecting documents. This might be significantly quicker or slower based on your preferences.

Once your immigration attorney receives your documentation, it will take them around two weeks to prepare and finish everything. Then, they will submit your whole E2 petition.

Your application will then be sent to the consulate of the United States in your home country (consular processing). Alternatively, if you are in the United States, you can convert your status to E2 by submitting an application to USCIS.

Consular processing takes roughly two to three months

USCIS processes a change of status within two to three months. You might choose to expedite the procedure by paying a premium processing cost of $2,500. This will decrease the total processing time to 15 days. This procedure can be slowed by a request for additional evidence (RFE).

Remember that if you choose Premium Processing, USCIS is only required to respond within 15 days. USCIS may submit a request for additional documentation if they consider that your application is missing information or if they are confused about a particular point.

USCIS is no longer compelled to respond within 15 days after you respond to a request for evidence. USCIS may extend its response time.

Work authorization for US Immigration by Investment E-2 visa holders is restricted to the organization in which they have made an investment. They are not permitted to work for unrelated employers or engage in other employment.

Individuals in the United States holding another nonimmigrant status may, if eligible, submit Form I-129 to request a change of status to an E-2 visa.

Unless they are able to alter their status or obtain a new visa, the visa holder may be required to depart the United States if the E-2 business fails or ceases operations.

There is no direct route to permanent residency or a Green Card via the E-2 visa. Visa holders may, however, renew their status indefinitely provided they continue to satisfy the necessary criteria.
